Terms of Service

1. Who We Are

Dreamspun is a product of The Difference Is HIM, LLC, doing business through its software development division TDIH Family Labs, a limited liability company organized under the laws of the State of Oklahoma ("Company," "we," "us," or "our").

By downloading, installing, or using the Dreamspun application ("App") or visiting our website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.

2. Eligibility & Accounts

Age Requirements

Dreamspun is designed for use by parents, guardians, and family members on behalf of children. You must be at least 18 years old to create an account. The App is not intended to be used directly by children without parental supervision.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

3. The Service

Dreamspun provides AI-powered personalized bedtime story generation and narration. Using information you provide (such as a child's name, preferred companions, adventure worlds, and story style), our system generates original story content narrated by premium voices.

Free Tier

The free tier allows users to generate and listen to a limited number of stories per week at no charge. Free tier features are subject to change at our discretion.

Premium Subscription

Premium plans ("Solo Premium" and "Family Premium") are available on a monthly or annual subscription basis. Premium features include saving stories to a personal library, access to premium voice narration, and additional customization options. Subscriptions are managed through Apple's App Store and are subject to Apple's subscription terms.

AI-Generated Content

Stories are generated using artificial intelligence. While we design the system to produce warm, age-appropriate content, AI outputs are dynamic and may occasionally require review. We are not responsible for any content that does not meet your expectations, though we are committed to continuous improvement. You may report any concerning story content to neil@thedifferenceishim.com.

4. Subscriptions & Billing

• All purchases are processed through the Apple App Store.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Refunds are handled in accordance with Apple's refund policies.
• We reserve the right to change pricing with reasonable notice to subscribers.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable regulations
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use automated tools to generate stories at scale or scrape content from the App
• Share, resell, or sublicense generated story content for commercial purposes without our written consent
• Attempt to manipulate the AI system to generate harmful, abusive, or inappropriate content
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

6. Intellectual Property

Our Content

The Dreamspun name, compass star logo, brand identity, App design, and underlying technology are the property of The Difference Is HIM, LLC. All rights reserved.

Generated Stories

Stories generated through the App are created for your personal, non-commercial use. You are granted a limited, non-exclusive license to use, read, and share generated stories for personal family use. You may not reproduce, distribute, or commercialize generated stories without our written permission.

Your Input

You retain ownership of any personal information you provide (such as your child's name). By providing this information, you grant us a limited license to use it solely for the purpose of generating your personalized stories.

7. Privacy

Your use of Dreamspun is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We are committed to protecting the privacy of your family, particularly in compliance with the Children's Online Privacy Protection Act (COPPA).

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DIFFERENCE IS HIM, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

Our total liability to you for any claim arising from or related to these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless The Difference Is HIM, LLC and its members, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. Upon termination, your right to use the App ceases immediately. Saved stories may no longer be accessible after account termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Oklahoma.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by sending a notification through the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
